In this document, “Us”, “Our”, and “We” means OZG Systems Engineering, LLC and “You” and “Your” means you, the user.
By purchasing and/or using the Digital Evaluation Board (the “Product”), you signify your assent to these Terms and Conditions of Use. If you do not agree to all these Terms and Conditions, please refrain from using the Product.
YOU HEREBY ACKNOWLEDGE that the Product is an educational device designed to be used for circuit board prototyping and/or to carry out the laboratory component of various classes. It is designed to transmit electrical current and therefore may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, shock, electrocution, and fire or electrical damage to You, others, or physical property. These risks are inherent to the use of the Product, and therefore You must use the Product only in its intended manner. You acknowledge that We are NOT responsible for the errors, omissions, acts, or failure to act of You or any other third party that You may use the Product with or near.
YOU HEREBY ACKNOWLEDGE that the Product cannot simulate everything that can be done in a university laboratory and that use of the Product may not allow for the same educational experience. We take no responsibility for your educational performance.
YOU HEREBY ASSUME ALL OF THE RISKS OF USE of the Product whether such use is proper or whether it is negligent, careless, or reckless. You totally assume these risks of such use and the danger inherent in the Product. In the event that the Product is functioning improperly you must cease use immediately. Continued use of a malfunctioning Product could lead to serious injury or death.
YOU HEREBY WAIVE, RELEASE, AND DISCHARGE US from any and all liability, including but not limited to, liability arising from Our negligence or fault, for your death, disability, personal injury, property damage, or actions of any kind that may hereafter occur to you as a result of Your use of the Product.
YOU HEREBY INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE US for any and all liabilities or claims made as a result of Your use of the Product, including but not limited to liabilities and claims of third parties being damaged by Your use of the Product.
YOU HEREBY ACKNOWLEDGE, that all right, title, and interest to any patents, patentable material, trade secrets, copyrights, trademarks, moral rights, and any other intellectual property associated with the Product vests solely in Us.
Any dispute arising under these Terms and Conditions of Use shall be litigated exclusively in the Court of Common Pleas of Centre County, Pennsylvania. These Terms and Conditions shall be subject to the laws of the Commonwealth of Pennsylvania without reference to its conflict of laws principles.
YOU CERTIFY THAT YOU HAVE READ THIS DOCUMENT, AND YOU FULLY UNDERSTAND ITS CONTENT. YOU ARE AWARE THAT THIS IS A RELEASE OF LIABILITY AND A BINDING CONTRACT.
OZG Systems Engineering, LLC Limited Warranty
This Limited Warranty applies to physical goods (the "Product"), and only for physical goods, purchased from OZG Systems Engineering, LLC ("OZG") including the Digital Evaluation Board. This warranty extends only to the original purchaser. Proof of purchase (e.g., original receipt, invoice, or order confirmation) is required with your warranty request.
What does this Limited Warranty cover?
This Limited Warranty covers any defects in material or workmanship discovered during normal use of the Product.
Warranty Period
The Warranty Period for a Product purchased from OZG is 30 days from the date of purchase.
What will we do to correct problems?
The purchaser is responsible for delivering the Product and proof of purchase to our facility at:

OZG will cover the cost of return shipping for repaired or replaced items. OZG reserves the right to determine whether the Product will be repaired or replaced. At no charge, OZG will either replace the Product or repair it using new or refurbished replacement parts.

Disclaimers and Limitations of Liability
EXCEPT AS EXPRESSLY PROVIDED IN THIS LIMITED WARRANTY, OZG SYSTEMS ENGINEERING, LLC DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
UNDER NO CIRCUMSTANCES SHALL OZG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE PRODUCT.
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
